A second failure-to-pay-overtime lawsuit has been filed against Westlake Hardware, Lenexa, Ks., one month after a previous case reached a settlement agreement. 

A district court judge conditionally certified a potential class of over 300 supervisors and managers. The suit also seeks unpaid overtime and damages for alleged wage and hour misclassification under federal law. Westlake maintains that the allegations have no merit.

In the earlier case, Westlake agreed to pay $125,000 in overtime and penalties plus $130,000 in attorney fees and court costs to 16 employees. Westlake settled to avoid the costly litigation, insisting it had not violated the law.
